These Terms and Conditions govern all services provided by the Supplier RIO CARIOCA TOUR (hereinafter, “We”) to the Client (hereinafter, “You”).

1. Definitions:
“Contract” means an intermediary contract between RIO CARIOCA TOUR and You.
“Intellectual Property and Proprietary Information” means any and all copyrights, trademarks and other proprietary information, including but not limited to text, software, images, graphics, video, sound, trade names, domain names, know-how, pricing information, confidential information, and the RIO CARIOCA TOUR logos.
“Personal Information” means any contact information that You provide us when purchasing the Services through our Site.
“Price” means any remuneration to be paid in exchange for the Services.
“Services” means any reservation or booking services provided by RIO CARIOCA TOUR to You through a Contract regarding any Tours and Activities.
“Term” means the period of this agreement that will begin on the date of this Agreement and will remain in full force and in effect for a period of one year.
“Tours and Activities” means any tours and/or activities offered by us, including without limitation, tours, shows, meals, lodging or transport services.
“Voucher” means a voucher for use of specific Tours and Activities booked by You.
“You” means any person who benefits from an undertaking of the Services, whether the contract is concluded, or the price paid by himself or by another person for you.

2. Product Availability, Pricing and Amendments:
I. We agree to update You regarding information about close outs, availability, prices, photos, text, and any other promotions.
II. We reserve the right, for technical or operational reasons, to alter the content, order and/or scheduling of the Services or the Tours and Activities, before or during their execution.

3. Reservations/Booking Process:
I. You will take bookings and receive a confirmation.
II. Amendments. Any questions or request for booking alterations shall be communicated in writing to our Customer Service department at [e-mail address: comercial@riocariocatour.com.br].
III. Voucher. We accept electronic or printed voucher given by the customer. No Tours and Activities are delivered if the Voucher and a valid photo ID are not shown or if these do not correspond with the information registered on the booking.
IV. Booking information – Tours and Activities. You are responsible for providing us with the proper information for this activity to take place. Otherwise, we will not be able to provide the service and we will still receive payment for it. You must provide us the following information:
· Tour and activity code and name.
· Number of adults, children and infant.
· Full name of at least 1 (one) customer.
· Contact information (email/ phone number) in the event we must email them any information.
· Tour date.
· Hotel location for the pickup service.
V. Booking information – Transfers. You are responsible for providing us with the correct flight details. You must inform us of the following information:
· Tour and activity code and name.
· Number of adults, children and infant.
· Full name of at least 1 (one) customer.
· Contact information (email/ phone number) in the event we must email them any information.
· Airline company and flight number.
· Date of arrival/ departure.
· Expected arrival/ departure time.
· Hotel location.
VI. If the airline company and flight number details do not match the expected time of arrival/ departure, our decision will be based on the airline company and flight information provided by You. If the airline company and flight number do not exist or apply to a flight that does not have routes to the destination, our decision will be based on the time scheduled provided by You. If we do not receive the information about airline company, flight number and expected arrival/ departure time, we have the right to not provide the service requested and we expect payment for it.
VII. Special Tours and Activities. As special Tours and Activities are meant to be provided on a specific date and count with limited availability, tickets to any special Tours and Activities including but not limited to Carnival and any other similar events are not refundable under any circumstances.
VIII. Gift Certificates and Coupons. Gift Certificates or any other coupon tickets are not refundable under any circumstances.
IX. Group Reservations. Special Prices, conditions and restrictions may apply for group reservations of 6 passengers or more.
X. Emergency. In case of emergency, you may contact us at our 24hr emergency number at [phone number: +55 21 98806 5075].

4. Cancellations:
I. We may cancel any Services or Tours and Activities where any of the following circumstances appear:
· Where force majeure or fortuitous events occur.
· Where the delivery of the Services or the Tours and Activities is not possible, despite us having worked with foresight and due diligence, and through no fault.
· Where there is a failure to reach a sufficient number of reservations or bookings. Any cancellations made by Rio Carioca Tour of bookings already made by You will be informed in advance.
II. Timing. Once the Tours and Activities have started, it is not possible to suspend, modify or cancel any reservation or booking. The voluntary non-use of the Tours and Activities shall not result in any claim, refund or reimbursement. We shall not provide any refund if You did not inform the client to fulfill the requirements specified in the Tours and Activities descriptions.
III. Cancellation Process. Cancellations requested 24 hours prior to the scheduled date of the Tours and Activities are entitled to receive a full refund – except for Carnival related tours and services. Cancellations must be communicated in writing to our Customer Service department at [e-mail address: comercial@riocariocatour.com.br]. In case of emergency, you may contact us at our 24hr emergency number at [phone number: +55 21 98806 5075]. You can only consider your tour to be cancelled after receiving confirmation per writing by RIO CARIOCA TOUR.
IV. Refunds. All refunds shall be performed through the same payment method used by You when booking the Tours and Activities. Therefore, any refunds shall be delivered exclusively under the rules and transfer times of the respective bank, as applicable, and any rates or fees charged by them shall be at your exclusive charge. No refunds will be provided in cases of cancellation by You due to bad weather.

5. Force Majeure:
I. Notwithstanding the other provisions of this Agreement, neither party shall be liable for any failure to perform its obligations hereunder if such a failure is caused by an event of Force Majeure.
II. For purposes of this Agreement, the term “Force Majeure” shall mean any strike, lock-out or other industrial action, fire, damage to, or destruction in whole or in part of the facilities of either party inability to obtain raw materials or supplies, war, riot or revolution, acts of God, pandemic or any other circumstances beyond the reasonable control of either party.

6. Customer Service/Complaints:
We provide customer service support to resolve inquiries or issues raised by You and respond to resolve such issues as soon as possible.

7. Confidentiality and Intellectual Property:
I. You shall not share any Personal Information under any other circumstances, unless it is required by any relevant authorities to satisfy a legal procedure or to detect, prevent or address fraud, security or technical problems. In such case, you shall furnish only that portion of the Personal Information which is strictly required for said purposes and you must request written consent by RIO CARIOCA TOUR.
II. Our Site, Vouchers, printed materials and all communications with You contain Intellectual Property and Proprietary Information protected by international treaties. You agree that all such Intellectual Property and Proprietary Information is the exclusive property of RIO CARIOCA TOUR. You are not allowed to use them in whatever form and for whatever purpose unless approved by RIO CARIOCA TOUR in writing prior to such use.
III. Any copying, downloading, transmitting, posting, linking, redistributing, reverse-engineering, distributing, creation of derivative works, modifying or otherwise exploiting said Intellectual Property and Proprietary Information without our prior express written consent is strictly prohibited and shall be duly prosecuted.
IV. You agree not to act or use any of the rights granted by these Terms in a manner which is prejudicial to or defamatory of RIO CARIOCA TOUR and/or any of its associated brands or third-party suppliers. The provisions of this clause shall continue to apply after the expiry or termination of the Agreement, as well as in the event of cancellation of the booking.

8. General:
I. Any disputes in relation to this Agreement shall be referred to the courts of Brazil and shall be governed by the laws of Brazil.

9. Payment Procedure:
I. The payments shall be delivered under the rules and transfer times of the respective bank, as applicable, and any rates or fees charged by them shall be at your exclusive charge.

10. Privacy Policy:
I. We collect important information for the provision of Tours and Activities.
II. If you do not provide us with the necessary Personal Data, We may not be able to provide you with our products and / or services.
III. We store your personal data for as long as it is necessary for our operations.
IV. By purchasing our services, You consent in providing us with the rights to use the pictures and videos taken of you during the activity. We may publish them on any channel or media we want to.
